The Will of Henry Hay Wake 1844 - 1911 Dated 8 June 1910

This is the last Will of me, Henry Hay Wake of Sunderland, in the County of Durham, Me. I. L. E. Engineer of the River Wear Commissioners, made this eighth day of June one thousand nine hundred and ten.

Whereas under my marriage settlement dated 8 July 1873, certain special powers of appointment over a certain Policy of Insurance and certain household furniture are, in the events which have happened, now vested in me.

Now therefore in exercise of the powers of appointment given to me by the said settlement, I hereby appoint the said household furniture to my daughter Enid Hay Wake absolutely, if she shall be unmarried at the time of my death, but if she shall be married at the time of my death, then I appoint the said household furniture to all my children who shall survive me and attain the age of twenty one years.

I hereby appoint the said Policy of Assurance unto all my children who shall survive me and attain the age of twenty one years.

I bequeath my watch to my son Harry Stafford Wake, and my dressingcase to son Mervyn Hay Wake.

I appoint my sons Harry Stafford Wake, Mervyn Hay Wake, and Leonard Scott Iliff, of Sunderland, Solicitor to be Executors and Trustees of this my will, and give, devise, and bequeath to them, all my real and personal estate, upon trust, to sell and convert the same into money, and after payment of my just debts, and funeral and testamentary expenses, to stand possessed of the surplus, upon trust, to invest the same and pay the income thereof, to my daughter Enid Hay Wake, until she shall marry, and on her death or marriage, the capitol shall be in trust in equal shares for all my children who shall survive me, and attain the age of twenty one years.

I revoke all former Wills.

On the 4th day of April 1911 Probate of this will was granted at Durham to Harry Stafford Wake, Mervyn Hay Wake, and Leonard Scott Iliff, the executors.
